Limited Warranty

1. Who may use this limited warranty?
Turing Video sells Products (as defined below) via (a) third-party authorized distributors (“Authorized Distributors”) who purchase Products from Turing Video and have been authorized by Turing Video to resell Products to Authorized Dealers (as defined below) and to end customers and (b) third-party authorized dealers (“Authorized Dealers”) participating in the Turing Partner Program who purchase Products from Authorized Distributors or Turing Video and have been authorized by Turing Video to resell Products to end customers.
Turing Video makes the following limited warranty (i) to Authorized Dealers who originally purchased Products directly from Authorized Distributors or Turing Video and (ii) to end customers who originally purchased Products directly from Authorized Distributors or Authorized Dealers (collectively, “you”).

2. What is covered by this limited warranty?
This limited warranty covers Turing-branded devices, which are referred to herein as “Products”. Turing Video makes the limited warranty to you that the Products are free from defects in material and workmanship.

3. What is the period of coverage?
The duration of this limited warranty is three years from the date of your purchase of the Product, as shown on the invoice from the Authorized Distributor, Authorized Dealer or Turing Video, as applicable (“Product Purchase Date”).
In addition, if (a) the Product is either a Turing-branded camera (not recorders and not bridge devices) or a Turing-branded outdoor “Shield” device, (b) you concurrently purchase a Turing SaaS services subscription for the Product and you maintain such Turing SaaS services subscription continuously, and (c) you activate the Turing SaaS services subscription within 90 days after the Product Purchase Date, then the duration of limited warranty for that camera Product is extended through the duration of your Turing SaaS services subscription for the Product, up to a maximum of ten years after the Product Purchase Date.

4. What are your remedies under this limited warranty?
If you discover within the above period a failure of the Product to conform to the limited warranty set forth above, you must promptly notify the Authorized Distributor or Authorized Dealer from whom you purchased the Product, except that if you encounter difficulty contacting your Authorized Distributor or Authorized Dealer, or if you purchased the Product from Turing Video directly, you may instead contact Turing Video by phone at 1-866-816-7426 or in writing at the following address: 1730 South El Camino Real Suite 480, San Mateo, California 94402. To be effective, such notification must be received within the warranty period describe above. Within a reasonable time after such notification, Turing Video will correct any defect in material or workmanship, with either new or used replacement parts or Product. Such repair, including both parts and labor, is at Turing Video’s expense. All warranty service will be performed at service centers designated by Turing Video. If Turing Video is unable to repair the Product so as to conform to the limited warranty after a reasonable number of attempts, Turing Video will provide a replacement Product. You are responsible for costs incurred for shipping the Product to Turing Video. Turing Video will bear all costs of ground return shipping to you, except with respect to any ineligible Product not covered under this limited warranty, for which you will bear all shipping costs. THESE REMEDIES ARE YOUR SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF WARRANTY.

5. What is not covered by this limited warranty?
Turing Video does not warrant (a) any products, components or parts that are not Turing Video-branded, (b) damage due to normal wear and tear, (c) defects caused by failure to provide a suitable installation environment for the Product, (d) damage caused by use of the Product for purposes other than those for which it was designed, (e) damage caused by disasters such as fire, flood, wind, and lightning, (f) damage caused by unauthorized attachments or modification, (g) damage during shipment, transportation or storage, or (h) damage caused by accidents, abuse or misuse.

6. DISCLAIMER OF WARRANTIES.
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, TURING VIDEO DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, TURING VIDEO LIMITS THE DURATION OF AND REMEDIES FOR BREACH OF SUCH WARRANTIES TO THE DURATION AND REMEDIES OF THE EXPRESS LIMITED WARRANTY DESCRIBED ABOVE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

7. LIMITATION OF LIABILITY.
IN NO CASE SHALL TURING VIDEO BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES BASED UPON BREACH OF WARRANTY OR ANY OTHER LEGAL THEORY. SUCH DAMAGES INCLUDE, BUT ARE NOT LIMITED TO, LOSS OF PROFITS, LOSS OF DATA, LOSS OF SAVINGS OR REVENUE, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT AND COST OF ANY SUBSTITUTE EQUIPMENT, FACILITIES OR SERVICES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

This limited warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
